The Facebook and Cambridge Analytica debacle has shone a spotlight on what can happen to individuals’ personal data. There have been calls for tighter legislation.

The European Union has already recognised the problems. It has been working on giving greater data protection to its residents. On 25th May 2018, that protection comes into force in the form of the General Data Protection Regulations (‘GDPR’).

Big businesses are taking the GDPR very seriously. The maximum fines for a data breach are eye watering: twenty million euros or four per-cent of global turnover for the previous financial year of a business, whichever is greater.

Added to that is the potential for civil law suits against businesses that have data breaches. Therefore, compliance with the GDPR as a way of demonstrating that businesses haven’t been negligent in handling personal data is just as important as avoiding fines.

The GDPR also apply to businesses outside the EU that hold the personal data of EU residents.

Many small businesses are not aware of the GDPR. Even if they are, some assume that the new Regulations only apply to big businesses.

But the GDPR apply to all businesses. Think of the GDPR as ‘health and safety’ for data. If you run a small business, you will still need to understand the new Regulations and apply them to the personal data that your business holds.

Compliance with the new Regulations isn’t a ‘one-size-fits-all’, one-time activity. Like health and safety law, it’s a continuous process.

The first step is to understand the basic concepts of the GDPR, such as ‘data subjects’, ‘data controllers’ and ‘data processors’.
